حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مَسْلَمَةَ، عَنْ مَالِكٍ، عَنْ حُمَيْدٍ الطَّوِيلِ، عَنْ أَنَسِ بْنِ مَالِكٍ قَالَ: كُنَّا نُسَافِرُ مَعَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَلَمْ يَعِبِ الصَّائِمُ عَلَى المُفْطِرِ، وَلاَ المُفْطِرُ عَلَى الصَّائِمِ

Chapter [37]: Not to criticize each other for observing ṣawm or not (on journeys)

Ḥadīth [1947]: It is narrated on the authority of Anas bin Mālik (may Allāh be pleased with him) that he said: ‘We used to travel with the Prophet (peace and blessings of Allāh be upon him) and neither did the fasting persons criticize those who were not fasting, nor did those who were not fasting criticize the fasting ones.’

The connection between the chapter name and ḥadīth is clear. It is not allowed for the one who is fasting while traveling to lash out against the one who is not fasting, as the former is acting according to a concession given by the sharī’ah. No one has the right to stop someone from taking a shar’ī concession, and this is a principle that applies to all such concessions in the sharī’ah.

1. Both fasting and breaking the fast are permissible while traveling. If a fast is broken during the month of Ramaḍān, it must be made up later on. If traveling in very hot conditions or the fast becomes very difficult, then it is preferable to break the fast.
2. Sayyiduna ‘Abdullāh ibn ‘Umar (may Allāh be pleased with him) did not fast while traveling (Muwaṭṭa’ Mālik (663 (1/295)) with a ṣaḥīḥ sanad). On the other hand, ‘Urwa bin az-Zubayr would fast while traveling (Muwaṭṭa’ Mālik (664 (1/295)) with a ṣaḥīḥ sanad).
3. If two ways are established in the sharī’ah, one should not object to someone who acts on either one of them.
4. It is completely acceptable to reject any speech that goes against the Qurān and the Sunnah.
